Ohio Sets New Package and Potency Limits for Cannabis Products
COLUMBUS – The Ohio Department of Commerce Division of Cannabis Control adopted the rule, which applies to products intended for direct sale to recreational consumers and medical patients.
- It generally bars products from exceeding 90% THC.
- Packages of dried flower are limited to one ounce.
- Raw single-serving units may contain no more than one gram each, with a package maximum of five grams.
- Vape packages can hold up to three devices or cartridges, each limited to two grams and 90% THC. The same package and potency caps apply to other concentrates.
Adult-use edibles remain capped at 10 milligrams of THC per serving and 100 milligrams per package. Medical edibles may reach 55 milligrams per serving, with higher package totals allowed. Recreational beverages are limited to 10 milligrams of THC per container, while medical versions carry higher serving and package allowances.
Oral pouches and strips face a 10-milligram serving limit and 100-milligram package limit. Capsules and pills may contain up to 50 milligrams of THC each and one gram of THC per package. Topical products like sprays, salves and lotions are limited to three ounces or 85 grams per package and no more than one gram of THC. Patches are capped at 50 milligrams each and 500 milligrams per package.
The rule also restricts packages of clones, live plants or seeds to six units each, with plants required to remain in a vegetative state. Daily purchase limits remain separate from these package standards. The Division has stated that the package rules largely align recreational products with quantities already used in the medical market. The final rule was filed in late August and becomes effective today, October 5, creating a uniform set of package and potency boundaries across Ohio’s dual medical and adult-use channels. Operators will need to adjust inventory, labeling and production runs to meet the caps, while consumers will see clearer differentiation between medical and recreational product strengths.
