California Moves to Broaden Cannabis Consumer Rights with New Bills

LOS ANGELES- California lawmakers are moving forward with legislation aimed at enhancing the rights of cannabis consumers. Two significant bills have advanced to Governor Gavin Newsom’s desk, which could potentially alter the current state of cannabis consumption and employment rights concerning the use of the substance.

Expanding Access to Medical Cannabis in Healthcare Settings

Senate Bill 302 is set to broaden the provisions of the existing Compassionate Access to Medical Cannabis Act, also known as Ryan’s Law. If signed into law, it will allow patients aged 65 or older suffering from chronic diseases to legally access specific cannabis products in private hospitals and other eligible healthcare facilities, a right previously reserved for terminally ill patients. However, the use of cannabis in these settings will be strictly controlled, with the inhalation or vaporization of herbal cannabis prohibited, and healthcare personnel barred from administering cannabis products. This bill has received unanimous support from lawmakers across both chambers.

Enhancing Worker Protections Regarding Cannabis Use

Senate Bill 700 aims to foster a more inclusive work environment for individuals who consume cannabis outside the workplace. The proposed law would prohibit employers from inquiring about an applicant’s past cannabis use during the hiring process. This builds upon the worker protections established in 2022, which made it illegal for employers to discriminate or penalize employees based on their off-the-job cannabis consumption. Once enacted, the new worker protection laws are expected to take effect from January 1, 2024.

Paul Armentano, NORML’s Deputy Director, applauded the anticipated policy shifts, emphasizing that cannabis consumption outside of working hours should not be a basis for employment discrimination. He asserted that employees who consume cannabis during their personal time do not pose any increased risk in the workplace and should be granted the same liberties as the consumption of any other legal substances off-duty.

A Third Bill on the Horizon

Furthermore, another bill, AB 374, is also under consideration by the Governor. This legislation seeks to expand the current laws governing cannabis consumption facilities, allowing them to serve non-cannabis food or beverages to their patrons. The bill also paves the way for these establishments to host live events, including musical performances, with the option to sell tickets for these events.
