Kool Cigarettes Sues Bloom Cannabis For Logo Infringement
GREENSBORO, N.C. – Tobacco producer ITG has sued a California cannabis company Capna Intellectual doing business as Bloom Brands accusing it of infringing upon its logo.
ITG say Bloom’s interlocking OO design (pictured) was too close to the interlocking OO in Kool cigarette. ITG, who also make brands like backwoods, have sued Bloom for copyright infringement.
The issue is a major problem in cannabis because brand logos are not easily registered for cannabis brands as cannabis is technically still illegal. Bloom is a common name in cannabis. There is also a Bloom Farms and a Blüm, a cannabis retailer to add to the confusion. While the share the same Bloom name, they have different logo designs.
According to Marijuana Business Daily, Kool owner said that the Bloom Brand’s logo is “a ‘rip-off’ of Kool’s longstanding brand image.”
Capna has reportedly submitted an application for a service mark for Bloom, but the lawsuit states it resembles to Kool’s ‘interlocking letters’ way too much.
ITG first reacted back in December, by sending a cease-and-desist letter in response to Bloom’s service mark application. It remains unknown if the cannabis company has replied to it.
Kool owner’s next step was to file the lawsuit, which they did this past Jan. 28.
